Disadvantage
Direct or immediate discrimination occurs when a person is treated less favourably than another person is, has been or would be treated in a comparable situation because of one or more characteristics1 that are worthy of protection. Direct discrimination on grounds of sex also exists in relation to less favourable treatment of a woman because of pregnancy or maternity.
Indirect discrimination occurs when an apparently neutral provision, criterion, procedure or action, when applied in practice, has an adverse effect and demonstrable unequal treatment on certain persons or groups because of one or more of the protected characteristics1 and without any objective reason.
An instruction to disadvantage a person shall be deemed to be a disadvantage. Such an instruction occurs when someone requests a person to behave in a way that disadvantages or may disadvantage a person because of one of the grounds.
